Service Description & Purpose

Through the website www.balkandestination.comwe (Balkan Destination shpk) act as an intermediate between hotels and users in order to provide the Suppliers with a platform where they can sell their products and our visitors with the possibility to search and book hotel accommodation, car rental, transfers, online. Our service is based on information provided by our Suppliers. We do our best to ensure that all information provided on this website is accurate. From now on the term “Balkan Destination”, “Websites” and “we” will be used to collectively identify Balkan Destination sh.p.k (Ltd), www.balkandestination.com , while the phrases “Guest” or “Client” will collectively refer to entities making use of these websites to complete a hotel or other service reservation.

Currency

Prices displayed in the Websites include all local applicable taxes and are in Euro.

Payment Method & No booking fees

There is not extra fee for online payments in our website. The price you see is the price you pay at the end of the services. The amount charged will be a partial amount of the total reservation price of services reserved, from now on known as the “Deposit”, for some of our services. The remaining difference between the total amount minus the deposit paid at the time of booking, from now on known as the “Balance” is due to be paid directly at the service provider, upon arrival and obtaining the services. The Client agrees that his/her credit/debit card will be charged by Pro Credit Bank on behalf of Balkan Destination. More detailed information regarding payment terms is given when you are transferred to Pro Credit Bank website for payment processing. In some cases the Client maybe required to prepay the total amount of his/her reservation or guarantee the booking in an alternative manner, such as bank transfer for example. If the Client is unable or unwilling to do this, we reserve the right to refuse the reservation service.

Online service agreement or contract for your Reservation

By making any of the reservation through our Websites a direct contract is created between the service provider, (hotel, car rental etc.) and the Client (the “online service agreement”). Balkan Destination acts merely as a medium which makes possible the reservation and payment of the Deposit or full payment. The Client is bound to accept the provider as a contractual party, to pay the remaining Balance at the hotel or other supplier, unless if full payment has been made to Balkan Destination,  and to accept the online reservation in compliance with the Provider Information contained on the Websites at the time the reservation was made.

Hotel Information, Rating & Client Complaints 

Hotel is responsible for ensuring all Information (i.e. description, photos etc.) included on the websites, www.balkandestination.com, is correct and up-to-date at all times. Finding ourselves only with a handful of officially rated hotels we have been forced to include also non rated hotels in our Websites. Rating has been decided by the owners or management of these hotels in consultation with us. We have inspected each of the hotels physically and the findings have been made known to the hoteliers to influence them in giving their properties as objective rating as possible. However online rating should only be considered a guideline to help you, in making a more informed choice. As a double measure we have also included guest rating. Balkan Destination shall not be held responsible in respect of any claim made by any third party relating to any erroneous Hotel Information and/or descriptions and/or photos or any other claims related to services provided by the hotel including possible discrepancies between the actual rating of a hotel and the online rating. Nor do we accept any responsibility for the guest rating section and the comments which appear there. Any complaints made by Guests regarding conditions and services provided by the hotel are to be dealt with by the Hotel directly, without mediation by Balkan Destination.

Prices and Price Parity

The prices on our site are highly competitive and we have agreements with many of our Suppliers  like: hotels, Car Rental etc.,  to guarantee that no one else undersells us. All prices on the website are shown per day regarding accommodation and the total amount reflects the price of the room for your entire stay and include VAT tax and all other local taxes (subject to change), unless stated differently. Please check the specific hotel booking policy for the reservation conditions and cancellation policy prior to making your reservation. While for rented a car, the price is for a car. For transfers the price is per transfer or per person. For tours the price is per person.

Cancellation Policy, Claims & Refunds

The Client has the opportunity to cancel or change the reservation or other service, but this may result in cancellation or reservation change fees, set by the service provider. Furthermore, if the Client does not show up, cancel or change his/her reservation before the cancellation terms are set by the hotel or service provider, directly with them, he will be subject to a charge of applicable nightly rates for hotels and set charges for other services. In these cases the rest of the reservation will be cancelled automatically and the equivalent of the cancellation penalty set by service provider will be withheld from the deposit paid. If the deposit paid by the client is less than the cancellation policy set by the service provider, than the client’s card maybe charged for the difference. If the deposit paid is more than the amount the service provider penalizes than the difference between the two will be refunded by Balkan Destination. The Client must notify the service provider directly if he would still like to arrive at the hotel on any remaining or alternative dates. The reservation for the following night will be a direct agreement between the client and service provider. The above cancellation policy will also apply to early interruption of reserved services. For exceptions to this rule we must have a written notice in the form of a letter, e-mail or SMS message from the hotel or service provider, confirming acceptance of the interruption of services from the client without penalty. It is the Client’s responsibility to check and accept the cancellation policy of the hotel or service provider he/her books as published on the Websites. Any financial claims and compensations will be strictly based on this policy.

Refund Policy

The following refund policy will apply to cancellation of services: If the Client proves that the cancellation or early check out was made in time and according to the hotels cancellation policy we will refund the deposit paid to Balkan Destination. For all other forms of payment, applicable bank or transaction fees will be charged. Cancellations made at least 24 hours in advance for services provided directly by Balkan Destination (i.e. transfers, FIT excursions, etc.) except for regular tours and those provided by suppliers ( i.e. hotels, car rental reservations etc.) will be refunded without any penalty.

Liability Disclaimer

The information, software, products, and services published on Balkan Destination owned websites kosovodestination.com, balkantravel-ks.com, kosovaholidays.com, balkanaccomodation.com, western-balkans.com, etc.,  or www.balkandestination.com have been compiled in good faith. However they may contain inaccuracies or errors, including pricing errors. In particular, Balkan Destination, our linked website partners through whom we provide service do not guarantee the accuracy of, and disclaim all liability for any errors or other inaccuracies relating to the information and description of the hotel, air, car and other travel products displayed on this website (including, without limitation, the pricing, photographs, list of hotel amenities, general product descriptions, etc.), much of which information is provided by the respective suppliers.   

In addition, Balkan Destination clearly reserves the right to correct any pricing errors on our website and/or on pending reservations made under an incorrect price. In such event, we will offer the Client the opportunity to keep his pending reservation at the correct price or, at his/her option; we will cancel his/her reservation without penalty. Balkan Destination makes no representations about the suitability of the information, software, products, and services contained on this website for any purpose, and the inclusion or offering of any products or services on this website does not constitute any endorsement or recommendation of such products or services by Balkan Destination. All such information, software, products, and services are provided "as is" without warranty of any kind. Balkan Destination disclaims all warranties and conditions that this website, its servers or any email sent from Balkan Destination Websites, are free of viruses or other harmful components. The hotels, car rental companies and other suppliers providing travel or other services on this website are independent contractors and not agents or employees of Balkan Destination. Therefore Balkan Destination is not liable for any errors, omissions, representations, warranties, breaches or negligence of any such suppliers and their employees or for any personal injuries, death, property damage, other damages or expenses resulting there from. Balkan Destination has no liability and will make no refund in the event of any delay, cancellation, overbooking, strike, force major, or other causes beyond its direct control, and it has no responsibility for any additional expense, omissions, delays, re-routing or acts of any government or authority. In no event shall Balkan Destination, be liable for any direct, indirect, incidental, punitive, special, or consequential damages arising out of, or in any way connected with, your access to display of or use of this website, including, but not limited to, your reliance upon opinions appearing on this web site; any computer viruses, information, software, linked sites, products, and services obtained through this website whether based on a theory of negligence, contract, tort, strict liability, or otherwise, and even if Balkan Destination, has been advised of the possibility of such damages.

If, despite the limitations Balkan Destination, is found liable for any loss or damage which arises out of or in any way connected with any of the occurrences described above, then Balkan Destination will in no event exceed, in aggregate (1) the amount the Client has paid for one of our services conform the term and conditions presented herein, or (2) One hundred and fifty Euro (€150.00). The limitation of liability reflects the allocation of risk between the parties and limitations specified in this section will survive and apply even if any limited remedy specified in these terms is found to have failed its essential purpose.

Compensation
The Client agrees to defend and indemnify Balkan Destination and/or their respective suppliers and any of their officers, directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of:

1. the Client’s breach of this Agreement or the documents referenced herein;
2. the Client’s violation of any law or the rights of a third party; or
3. the Client’s use of this Website.

Protection and enforcement of copyright

Balkan Destination is an exclusive owner of the general and executable project, and all software applications and content of www.balkandestination.com, kosovodestination.com, balkantravel-ks.com, kosovaholidays.com, balkanaccomodation.com, western-balkans.com,  www.balkandestination.com and websites. The author of all the information at these portals is Balkan Destination. The contents that are not in possession of Balkan Destination are identified as such in these terms and conditions and/or websites. Most photographs are the exclusive ownership of Balkan Destination. The copyright to all materials on the above-mentioned websites belongs to Balkan Destination. The user and the visitor of Websites cannot copy or use the information for profitable purposes without the knowledge and written permission of Balkan Destination. All rights are reserved. The permission is given by Balkan Destination only through prior agreement in writing form. With the exception of those mentioned in this section, all other uses of material from Websites are strictly prohibited. All perpetrators will be prosecuted based on local and International copyright laws.
